2257 Compliance

All our affiliates agree they are in USC 2257 compliance, if applicable. For more information about USC 2257, make sure that you consult your attorney.
Spamming
---------------
Spamming is NOT tolerated, and can result in immediate termination of your account and forfeiting of any payments to you. In additional, we reserve any of our legal rights for any damages we suffer due to your spamming. Also, you should not use our services via any method that violates any Terms of Service or contract which you have agreed to. Email lists ARE allowed provided these are opt-in members with clear and working opt-out provisions.
Illegal activities

We do not accept traffic, nor are you allowed to promote our services, on anything that is illegal. This includes, but is not limited too, child pornography, bestiality, and illegal intellectual property sites. We have the right to withhold funds or cancel accounts that are illegal or fraudulent.
Payout Structure

3% commission. You will get paid 3% commission on anything sold in the http://www.prostreetonline.com/oem/ category.
Definition of Qualified Order
-------------------------------------------------
We handle everything, you just send us the traffic!
A qualified order is one that meets all of the below conditions:
-- User completes order for any item in http://www.prostreetonline.com/oem/
-- User orders items online, not by phone. (Otheriwse we can't track it).
-- User's credit card is not declined.

Payment Method and Dates
-----------------------------------------
Payment is made approximately the 15th of the month following the month in which monies due are earned. Payment is made by company check or paypal for all monies due. Monies are not due until a minimum of $25.00 is reached. Checks are drawn on a US Bank in US Dollars.
Downtime/Errors
------------------------
We are not responsible for lost orders due to technical errors, downtime, or any other reason. All disputes over statistics will be resolved using Pro Street Online Affiliate statistics.
Law and Dispute Resolution
----------------------------------------
All disputes shall first be submitted to mediation for a 90 day period. If that is unresolved, then binding arbitration before one arbiter either mutually agreed too or randomly selected by the American Arbitration Association. The venue for all disputes shall be in Alameda County, California, and shall use California law.
Indemnification

You, as our affiliate, agree to indemnify and hold harmless our companies and this site from any actions/inactions of yours that cause any possible real or contingent liability.
